Neighbour Too Loud? A Guide To Noise Complaints In Strata Living
Living in a strata scheme often means sharing walls, floors, and ceilings with neighbours. While this setup offers many benefits, it can sometimes lead to disputes, especially when it comes to noise. It’s understandable how distressing a noisy neighbour can be. Below is a guide on how to approach a noise complaint in a fair and effective way.
Step 1: Understand the By-Laws
In NSW, each strata scheme has a set of by-laws, including rules about noise. These by-laws aim to ensure that everyone enjoys a peaceful living environment. Excessive noise that disturbs neighbours may be a breach of these by-laws. Before taking action, review the by-laws to understand your rights and the rules that apply.
Step 2: Talk to Your Neighbour
The first step in resolving a noise complaint is often the simplest: talking to your neighbour. Politely explain the problem and how it affects you. Your neighbour may not realise the noise is causing an issue. A friendly conversation can go a long way in resolving the matter without escalating it further.
Step 3: Document the Noise Issue
If the problem persists, start documenting the noise disturbances. Note the dates, times, and nature of the noise, and keep a record of any conversations or attempts to resolve the issue. This documentation will be useful if the matter needs to be taken further.
Step 4: Report the Issue to the Strata Committee or Strata Manager
Raise the matter with your strata committee or strata manager. Provide the documentation you’ve collected and explain how the noise breaches the by-laws. The committee and strata manager can assist with enforcing these rules and may issue a notice to the offending resident.
Step 5: Seek Mediation or Formal Dispute Resolution
If all other attempts to resolve the noise issue have failed, consider formal dispute resolution options. Mediation services are available to help parties reach a mutually acceptable solution. If mediation doesn’t work, you may need to apply to the NSW Civil and Administrative Tribunal (NCAT) for a ruling on the matter. The owners corporation may also step in and proceed with mediation or seek orders from NCAT to enforce the by-laws.
Preventing Noise Issues in Strata Living
The owners corporation can use the following strategies to inform all residences on how minimise noise while living in strata:
Soundproofing: Encourage residents to use rugs, curtains, and other soft furnishings to absorb sound.
Clear By-Laws: Ensure by-laws are specific about acceptable noise levels and times, such as limiting loud activities to certain hours.
Communication: Promote open communication among residents to address issues before they escalate.
